Terms & Conditions

Last Updated: 18 April 2025  ·  Effective: 18 April 2025

1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of the Kowloon Bridge website at kowlobridge.digital ("Site") and your engagement of Kowloon Bridge services. By accessing the Site or enquiring about our services, you agree to these Terms. If you do not accept them, please do not use the Site.

Kowloon Bridge is operated from 18 Canton Road, Tsim Sha Tsui, Kowloon, Hong Kong. These Terms are governed by the laws of Hong Kong Special Administrative Region.

2. Website Use

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable Hong Kong or international law or regulation
  • Transmit any unsolicited or unauthorised advertising or promotional material
  • Attempt to gain unauthorised access to any part of the Site or its connected systems
  • Use automated tools to scrape, copy, or extract content from the Site without our written permission
  • Introduce viruses, malicious code, or other material that is harmful to our systems or other users

We reserve the right to restrict or terminate access to the Site at our discretion, without notice, where we reasonably believe these Terms have been violated.

3. Intellectual Property

All content on this Site — including text, design, graphics, service descriptions, methodology descriptions, and structural elements — is the intellectual property of Kowloon Bridge or is used under licence. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

Nothing in these Terms grants you any licence to use our trade name, trademarks, service marks, or logos.

4. Service Engagements

Enquiries submitted through this Site do not constitute a contract for services. A service engagement is only established when a written scope agreement is signed by both parties. Until that point, no obligation to provide services or pay fees exists on either side.

Specific terms governing the delivery of any service — including scope, deliverables, fees, timelines, and data handling — are set out in the scope agreement for that engagement. In the event of conflict between these Terms and a signed scope agreement, the scope agreement takes precedence in respect of the specific service.

5. Fees and Payment

All fees quoted in service scope agreements are denominated in Hong Kong Dollars (HKD) and are exclusive of any applicable taxes. Payment terms are set out in the relevant scope agreement. We reserve the right to suspend service delivery where invoices remain unpaid beyond agreed terms after written notice has been given.

Fees listed on the Site are indicative and subject to change. The fee applicable to your engagement is the fee set out in your signed scope agreement.

6. Limitation of Liability

To the fullest extent permitted by Hong Kong law, Kowloon Bridge shall not be liable for:

  • Indirect, consequential, or incidental losses arising from your use of the Site or our services
  • Loss of profit, revenue, business, data, or goodwill
  • Decisions made by your team based on AI-generated outputs from our services, where those outputs have not been reviewed and approved as set out in the relevant scope agreement
  • Interruptions or errors in the Site or service caused by factors outside our reasonable control, including telecommunications failures, third-party platform outages, or force majeure events

Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under Hong Kong law.

7. Disclaimers

The Site and its content are provided on an "as is" basis. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Service descriptions on the Site are for general information purposes only and do not constitute professional advice.

AI-generated outputs produced by our services are planning aids and informational summaries. They are not substitutes for professional judgement. Our services are designed to keep human operators in authority over all consequential decisions, and we do not accept responsibility for actions taken without appropriate human review.

8. Confidentiality

We treat all client operational information shared with us in the course of service delivery as confidential. We will not disclose such information to third parties except as required by law or as necessary to deliver the service under a data processing agreement with equivalent protections.

We ask that you treat any proprietary methodologies, pricing structures, or internal documentation shared by us in the course of an engagement as confidential.

9. Data Protection

Personal data submitted through the Site or collected in the course of service delivery is handled in accordance with our Privacy Policy and the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong. By submitting personal data through this Site, you confirm that you have read and understood our Privacy Policy.

10. Third-Party Links and Content

The Site may contain links to third-party websites for reference or convenience. These links do not imply endorsement of, or affiliation with, those sites. We are not responsible for the content, accuracy, or practices of any third-party site. You access linked sites at your own risk.

11. Termination of Website Access

We may modify, suspend, or discontinue any part of the Site at any time without notice. We will not be liable to you for any modification, suspension, or discontinuation of Site access.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

Changes to the Terms do not affect the terms of any signed service scope agreement already in force.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

Where a dispute arises in connection with a service engagement, the parties agree to first attempt resolution through good-faith negotiation before initiating formal proceedings.
